Understanding Fair Use on Social Media
Repurposing and reacting to social media media clips is a cornerstone of modern digital commentary. However, failing to respect copyright laws or understand the legal boundaries of Fair Use can result in account strikes, demonetization, or takedown notices.
What Constitutes Fair Use?
Fair Use is a legal doctrine in the United States and similar jurisdictions allowing limited use of copyrighted material without permission for purposes such as criticism, comment, news reporting, teaching, and research.
The four primary statutory factors evaluated are: the purpose and character of use (transformative vs. verbatim copy), the nature of the copyrighted work, the amount used relative to the whole, and the effect upon the original work's market value.
Transformative Value is Crucial
Simply re-uploading someone else's Reel with a generic caption like "Wait for the end!" is NOT Fair Use. This is copyright infringement.
To qualify as transformative, your video should add meaningful critique, analytical commentary, educational breakdown, or original parody that adds new expression and meaning.
Best Practices for Content Creators
Always provide prominent attribution to the original creator in your on-screen caption and video text.
Never monetize or resell third-party content without obtaining written commercial synchronization licenses from the rights holder.
If a creator requests the removal of their clip, comply respectfully and promptly.
